Thanks for your business and we hope you enjoy your stay in our property!

TERMS, CONDITIONS AND POLICIES
In placing an online deposit to reserve any property with Agent, Guest certifies that he or she has read and agrees to all the terms, conditions, and policies set forth in this Agreement.  Each Rental Confirmation also includes all of these terms, conditions, and policies.  For reservations made over the phone, Guest will receive these terms, conditions and policies via email — this Agreement must be signed and returned in its entirety within forty-eight (48) hours in order to confirm the reservation.  If this Agreement is not signed by Guest and returned to Agent within forty-eight (48) hours after the time of the phone reservation, the phone reservation will be deemed null and void and Agent shall have the right to rent the Premises to other guests.

Age Requirement
The Guest who reserves the property must be a responsible adult twenty five (25) years of age or older. The guest making the reservation must also be checking into and staying at the property. Third party reservations are not accepted. Underage consumption of alcohol by anyone under the age of twenty one (21) years old is strictly prohibited. 
 
Reservation Deposit and Final Payment
All reservations require a deposit payable to Agent equal to 50% of the total rental fee due for the Premises (the “Initial Deposit”) in order to reserve.  This 50% deposit must be paid by credit card, the balance may be paid by personal check.  Agent requires a credit card on file for ALL reservations, including those paid for via personal check.  Final payment is due sixty (60) days prior to arrival, and reservation balances will be charged automatically to the credit card on file at that time unless previous arrangements have been made by Guest with Agent (see below).  Reservations made within sixty (60) days of arrival will require payment in full at the time the reservation is made and this Agreement is signed.  If paying via check, Guests are to send a copy of their reservation confirmation with their check to ensure that final payment is applied to the correct reservation profile.  It is Guest’s responsibility to notify Agent of final payments that are to be processed via check.  Both the Initial Deposit and final payment are subject to being Non-Refundable, see “Cancellations” below.
                                   
                  
Cancellations
** If you booked through  Airbnb or VRBO, please refer to the cancellation policy for that platform. **
 
There are no refunds for late arrivals and/or early departures.
 
Should Owner elect to remove the Premises from the Agent's vacation rentals program (“Vacation Rental Program”), Guest shall not hold Agent liable for damages of any kind.  In such instance, Guest will be relocated to comparable accommodations as determined by Agent in Agent’s sole discretion.  If comparable accommodations are not available, Guest will receive a full refund and reservation will be cancelled.

Check-in/Check-out
Check-in time is and check-out time is unless otherwise noted in written or email documentation from Agent.  Guest requests for early check-in and/or late check-out will be considered by agent upon request for a $75.00 fee.  Guest arrival at the Premises prior to a scheduled check-in time, or a late check-out after without written consent from Agent, will result in a One Hundred and Fifty Dollar ($150.00) fee for each occurrence.

Accidental Damage Waiver
Every Guest reservation shall be charged a non-refundable Accidental Damage waiver fee, variable per property (the “Accidental Damage Waiver”).  This Accidental Damage Waiver will cover accidental damages incurred at the Premises during a Guest’s stay in an amount up to Five Hundred Dollars ($500.00).  If the damage to Premises exceeds Five Hundred Dollars ($500.00), Guest shall be responsible for the balance and the guest authorizes this amount to be charged to the pre-authorized credit card on file.  All accidental property damages must be reported on or before the last full day of the reservation to Agent in order for the Accidental Damage Waiver to cover the damage.  This Accidental Damage Waiver does NOT cover intentional damage, theft, excessive cleaning, or any damage or flea infestation caused by a pet.  Please do not hesitate to report an accident as this Accidental Damage Waiver is in place to protect the Premises and the safety of our guests.
                                      
Property Damage
Any damages discovered by Guest upon arrival at the Premises must be reported to the Agent at the rental office via email to reservations@genevalakesvacations.com by 5:00 p.m. on the day after arrival (the "Reporting Deadline").  Failure to do so may result in a charge to Guest for damages that Guest did not create.  Any damages or theft to Premises incurred to the Premises and not reported in writing to Agent prior to the Reporting Deadline, shall be the responsibility of Guest.  Other than as set forth in the Accidental Damage Waiver section above, Guest will be responsible for any damages or theft incurred at Premises.  Agent reserves the right and Guest hereby authorizes Agent to charge Guest’s pre-authorized credit card, after notifying guest via email or phone call, for the cost of repairs, replacement, services, telephone charges, or extra cleaning as a result of any damage, breakage, excessive garbage, charges and/or loss incurred to the Premises and not reported to Agent prior to the Reporting Deadline. In the event of damage to the Premises, its equipment, furniture or carpeting, other than as set forth in the Accidental Damage Waiver section above, Guest shall be responsible for ANY and ALL costs, including but not limited to collection costs and attorney fees to recover payment for such damages.  Documentation detailing damages and charges will be provided to Guest.
                                       
Accommodations
All of the properties included in Agent's Vacation Rental Program are privately owned.  Therefore, each rental property will be uniquely different in decor, equipment, amenities, etc.  As a result, any misrepresentation by Agent regarding the condition or description of any or all properties is unintentional.  Agent will not be held responsible for changes made by Owners or environmental factors.  All properties come equipped with a basic supply of sheets and bath towels. We provide a start up supply of hand soap, dish soap, garbage bags, bathroom tissue, and general housewares.  We suggest you bring your own beach towels and beach chairs, coffee filters, shampoo and conditioner, laundry detergent, and other convenience items.

Housekeeping
All properties in Agents Vacation Rental Program are self-catering.  The Premises will be cleaned prior to Guest arrival, as well as upon Guest departure from the Premises.  The Premises will be set up with fresh bed linens, bath towels, and a toiletry start-up kit for arrival.  Guests are responsible for additional toiletries needed during their stay, as well as any mid-stay cleaning, such as taking out the trash, washing dishes, and washing the provided linens.

Mid-Stay Cleaning and Linen and Towel Service
Mid-stay cleans and linen service may be purchased for an additional charge.  Please contact Agent at reservations@genevalakesvacations.com or (262) 248-1735 for pricing and coordination prior to arrival.

Maintaining Property Condition
The Guest hereby agrees to maintain the cleanliness of the Premises during occupancy; including, a promise to exercise care in the treatment of the accommodations and furnishings.  Upon departure, Guest agrees to leave the Premises and furnishings in a clean and undamaged condition, which includes but is not limited to Guest starting the dishwasher, taking out the trash, and making sure all doors and windows are closed and in the locked position.  Agent shall have the right to charge Guest for an incomplete procedure at departure, any necessary repairs, and/or for any unusual degree of cleaning which may be necessary.  We strive to maintain a safe and secure rental environment for our Guests, as well as the surrounding communities in which our rental properties are located.  Therefore, Guests are strictly prohibited from possessing any objects hazardous in nature during their reservation; including, but not limited to, fireworks, explosives, flammable items, firearms, chemicals, etc.

Agent Entry
Agent may enter the Premises at any time in the event of emergency, but will use its best efforts to give 24-hour notice for normal maintenance or sales inspections.

Maximum Occupancy
Each property has a specific maximum occupancy, or number of people a Property sleeps.  Take note of the maximum number of Guests allowed in the homes and condos before making your reservation.  Occupancy and use of the home, suite(s), courtyard, and common area of the Premises by Guests or visiting invitees of Guests shall not be such as to disturb or offend neighbors, nearby residents, or other guests of other properties.  Guest understands and agrees that the maximum number of occupants as stated on the Rental Confirmation must not be exceeded, and in the event that the maximum occupancy is exceeded, Agent will evict immediately without notice all Guests and invitees of Guest.  This rule and requirement is made a part of this Agreement for insurance regulation requirements, fire code, and city ordinance requirements, and particularly for the safely of our Guests.

Parking
Guests shall only park in the driveway or designated parking spots.  No boats or cars may be parked on the lawn or road.  Each property has a maximum number of parking spots, and number of cars over this maximum number will be ticketed and towed immediately.  
 
Weddings/Events
No weddings, receptions, events, reunions, or parties of any kind are to be held at the Premises or in the courtyard or open areas of the Premises without the prior written consent of Agent.  The definition of an “event” is any gathering of people at the Premises that exceeds the maximum occupancy of the Premises as stated in the Rental Confirmation.  Agent has the right to inspect the Premises at any time during Guest’s stay to guarantee that this stipulation has not been violated.

STRICT NOISE ORDINANCE: We have a strict noise ordinance that must be followed. No loud noises, music, load vehicles are allowed between the hours of 10:00 pm and 7:00 am. Please note if the these are followed you can be fined and asked to vacate the property.

Smoking
All properties in Agent’s Vacation Rental Program are non-smoking.  Should we discover evidence of smoking at the Premises, Guests will be asked to vacate the Premises immediately without a refund.  In addition, Guests will be charged a deep cleaning fee, including, but not limited to, carpet, furniture, draperies, or bedding, and the equivalent of one night’s rent.

Illegal Substances
No illegal substances are allowed in the rental, and minors should not be in possession of alcohol. Violations will result in eviction from the property and no refunds will be issued.

Weather/Mother Nature
We cannot be held responsible for circumstances beyond our control. This includes excessive noise from construction or public/private events, wildfire/smoke, weather related interruptions, road closures, lack of snow, frozen pipes, interruption of services and utilities or unexpected appliance breakdown. Properties that are listed as Ski-in/ Ski -out, Ski Access, Walk to ski, and the ski accessible homes are subject to weather and we cannot be held responsible weather/snow conditions that make these homes ski accessible.

Pets
Pets are permitted in some, but not all of the properties of Agent’s Vacation Rental Program.  This will be specifically noted on each property’s information page and be detailed within your Rental Confirmation.  Guests are responsible for any and all damages caused by their pet.  Each community’s seasonal and year-round leash laws must be obeyed at all times.  Any Guest found with a pet in a property that does not permit will be required to vacate the Premises without a refund.  In addition, such Guest will be charged a fee for pest control, a deep clean, and an equivalent of one night's rent.  This policy is strictly enforced to protect the sanitary and health conditions of our rental properties.
 
Pool Heating
Some properties do come equipped with an outdoor pool, the temperature of which will be set to 75 degrees F. If a guest changes the temperature of a pool without written permission from the Agent, the guest will incur a $250 per day fine. Please contact the manager if you would like to heat the pool to a higher temperature for an additional fee. A Minimum of 48 hours notice is required to get the pool to your desired temperature prior to your stay. We cannot control pools that are located in an HOA Community, therefore cannot adjust the temperature or guarantee they will be operational.

Unit Changes
Every effort is made to accommodate Guests in the specific rental unit requested; however, the Owner of the unit may sell the Premises or otherwise make it unavailable.  Should this occur, Agent will make every effort to find suitable accommodations for the same period as stated in the Guest’s Rental Confirmation.  Rates may vary, and Agent’s liability is hereby expressly limited to a refund of any deposit or rental fees previously made by Guest.  GUEST HEREBY EXPRESSLY WAIVES ANY SPECIAL OR CONSEQUENTIAL DAMAGES AS A RESULT OF SUCH RENTAL CANCELLATION.
 
Internet
Internet service is available at many of the properties in Agent’s Vacation Rental Program; however we cannot guarantee connectivity or the equipment. Agent does not offer internet support beyond providing login or access information when available.  No refunds, full or partial, will be made for the failure of internet connection or equipment.
                
 
Repairs
Rental property equipment and amenities, such as TV’s, appliances, HVAC units, hot tubs, etc., may require service or replacement during your stay.  We cannot guarantee the operation of all appliances; however, we will work diligently to schedule necessary repairs as quickly as possible to limit the inconvenience.  If you suspect an issue with an appliance or equipment at the Premises, please contact Agent’s office immediately, and we will use our best efforts to correct the situation.  This correction may include making another property (of equal size and value) available for your use; however, this is not always possible.  Agent is not responsible to Guest for compensation of any part of rent due to failure of fixtures or appliances resulting in short term inconveniences.  If the Premises experiences a major appliance malfunction (HVAC, plumbing, electrical etc.) or if there is structural defect at the Premises during a Guest’s stay, Guest may be eligible for relocation or for a partial refund of Guest’s reservation payments.  In such an event, please contact the Agent immediately.

Resort Community/Local Ordinances
Guest agrees to abide by the covenants of any association and local ordinances within which the Premises are located.  Agent has the right to refuse or discontinue occupancy if Guest is found to be in violation of the rules and regulations set forth by the association or by local ordinance.  The Premises is located in a residential area, and as such, loud music and other disturbing noise will not be tolerated and are grounds for immediate eviction of Guest.  In all cases in which this Agreement and the Rental Confirmation is terminated due to a Guest’s disruptive behavior, all deposits and rental fees will be forfeited by Guest.

Watercraft & Other Recreational Vehicles
Guest shall notify Agent if intending to bring any personal boats, jet-skis, wave runners, ATV’s, snowmobiles or other recreational vehicles to the property. Allowance will be subject to Owner’s written permission and all zoning, local and association ordinances. Owner’s motorized watercraft, such as boats, wave runners, jet-skis, etc., are not included in any rental. All watercraft must be securely fastened to a dock, pier, or boat-lift station when not being used by Guest.  Agent is not liable for any injury resulting from Guest’s use of personal watercraft at the Premises, including but not limited to injuries resulting from defective docks, piers or boat-lift stations.  In the case of emergency, please contact 911 for immediate assistance.

Lost and Found
Agent is not responsible for personal items left at the Premises.  If you believe that you have left personal belongings at the Premise, please contact our office and we will use reasonable efforts to return those items to you.  Items not claimed within thirty (30) days after the termination of Guest’s stay at the premises will be donated.  If items left at the Premises need to be shipped to Guest, we require a valid credit card number to cover shipping costs.  A $25.00 service fee will also be applied.

UNFORESEEN OCCURRENCES
Management will not assume liability for any loss, damage or inconvenience caused by but not limited to the following: weather conditions, natural disasters, pests, construction, acts of God, or other reasons beyond its control. There shall be no refunds available as such instances are beyond the control of Management. It is highly recommend that Guest considers travel and/or rental insurance.

Termination of Rental Contract
Agent reserves the right to refuse or terminate occupancy at the Premises, if in its opinion Guest is detrimental to the Premises.  Any violation of the any of the terms, conditions and policies set forth in this Agreement will result in immediate eviction from the Premises, and Guest shall forfeit its entire rental fee and deposit amounts.
                 
Credit Card Information
In connection with the Rental Confirmation, Guest has provided a credit card number as a guarantee.  Guest hereby agrees to pay all rental fees and/or any outstanding long distance phone charges, Pay-Per View charges, On Demand charges, or other special ordered items during their stay. Guest accepts all terms of this Agreement, and accepts liability for any damage beyond normal wear and tear to the Premises and property during Guest’s stay at the Premises.  In the event that Guest causes damage beyond normal wear and tear, these costs will be charged to the credit card on file.  **All credit card information will be properly and securely destroyed upon the completion of the rental season**

Indemnification/Limitation of Liability
Agent assumes no liability for Guest’s stay in southeastern Wisconsin or the activities in which Guest partakes in during Guest’s visit.  Guest acknowledges that Agent is not responsible for any loss of money, jewelry, or other personal items of Guest or any invitees of Guest.  Guest hereby covenants and agrees to indemnify and hold Agent and Owner, and their respective members, managers, agents and employees harmless from and against any and all actual or alleged claims or damages, causes of action, liabilities, or losses to persons or property arising out of or in any way related to Guest’s or Guest’s invitees use of the Premises, including but not limited to, any damages resulting from the building or any part of it or any equipment or appurtenance belonging to the building becoming out of repair, or resulting from any accident in or about the building, or resulting directly or indirectly from any act of neglect of any Guest, invitee of Guest or of any other person.  Guest assumes the risk of injury and any related pain and suffering or medical expenses or other losses relating to the use of the Premises and/or recreational activities on the Premises or in the municipality where the Premises is located and will indemnify and hold Agent harmless with respect thereto.
